Oscar Mago, CEO and founder of the Peruvian law firm OMC Abogados & Consultores, reveals the two new specializations the firm is entering into through legal advice.
1. What are the new practice areas that OMC Abogados & Consultores has incorporated into its service portfolio?
Response: We are pleased to announce that, as of 2024, the portfolio of practice areas of OMC Abogados & Consultores will include two new specializations: advice on Regulatory Affairs and the Regulation of medical cannabis in Peru.
2. Could you explain a bit about the Regulatory Matters area? Who is it aimed at, and what does the advisory service you provide consist of?
Response: The Regulatory Affairs area provides technical and legal advice to companies and individuals interested in marketing, distributing, and importing pharmaceutical products, medical devices, and sanitary products. Our objective is to provide advice and assume responsibility for managing the permits required for products to be sold on the market and the sanitary authorizations for establishments before the relevant authorities.
3. What prompted you to provide legal advisory in the field of medicinal cannabis in Peru?
Response: One of the key reasons for providing legal advice in the field of medical cannabis in Peru is the imminent growth of the industry worldwide and the limited availability of legal advice on the subject in our country. We are aware of the interest from manufacturers (laboratories) and exporters to enter the Peruvian market and commercialize cannabis-based medications. In addition to being an interesting business opportunity for many, it would also benefit patients who could enjoy a wide and varied catalogue of medications according to their needs.
4. Do we have a legal framework that allows for the development of this industry in the country? If not, what path should be followed?
Response: Law No. 30681, enacted in December 2017, primarily defines the legal framework for medicinal cannabis. However, it must be acknowledged that the current legal framework is somewhat limited and does not allow for the full development of a regulated industry. While progress has been made in the legalization of medicinal cannabis, the legislation remains restrictive and does not address key areas such as large-scale production and commercialization.
